HOW IS THE COLLABORATIVE DIVORCE PROCESS DIFFERENT THAN MEDIATION?

Mediation takes place with a neutral third party, who does not provide legal advice, and who acts neither for you or your spouse. In Mediation you attend the sessions without your lawyer and must get advice outside the sessions. In Collaborative Divorce negotiation takes place and a 4-way meeting with both lawyers and both spouses working as a team. You will also meet with your lawyer individually where you will receive counsel and legal advice.

WHAT IF THE PROCESS IS NOT SUCCESSFUL?

The success rate of Collaborative Divorce is exceptionally high. However, if either spouse decides to discontinue the process, both lawyers must resign and have no further involvement. Both spouses then start fresh with litigation lawyers.

HOW LONG WILL IT TAKE?

Since you control the process, the length of time depends on your commitment.

WHAT MUST I BRING TO THE COLLABORATIVE PROCESS?

A willingness to participate in a open and honest dialogue, make full financial disclosure (this is also required in a litigated divorce), and to treat your spouse with respect.

HOW MUCH WILL IT COST?

The cost can be significantly less than litigation. The better you and your spouse are able to communicate the less it will cost.

CAN ANY LAWYER BE A COLLABORATIVE LAWYER?

For this process to succeed it is imperative that both lawyers be trained in the collaborative process. They also must be certified mediators. Grace Morin is a fully trained collaborative lawyer and mediator.
